2010 COCA-COLA SOCCER CAMP CONTEST OFFICIAL RULES

1. ELIGIBILITY: Contest is open only to, and all Nominators, Nominees and Coaches (as defined herein) must be, legal residents of one of the fifty United States or the District of Columbia. Nominators must be 13 years of age or older as of 2/25/10. Nominees must be between the ages of 13-16 as of 2/25/10 and in addition must be ages 13-16 to attend camp (born between 6/21/93 – 2/25/97.)

To be eligible, each of the Nominees must currently be, or have previously been (within the past year) a member of an organized soccer team. Nominees may be either male or female, but all Nominees on a Team must be the same gender. In addition, the Nominator must also include the name of the Team’s designated coach (the “Coach”). The Coach must be the soccer coach for at least one Team member’s organized soccer team, be 25 years or older as of 6/15/10 and must speak English AND the language spoken by the Nominees they will accompany.

Officers, directors and employees of The Coca-Cola Company, Coca-Cola Bottlers, Gage Marketing, LLC and each of their respective affiliates, subsidiaries, advertising and promotion agencies, and suppliers involved in this contest and each of the immediate family members (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step-brother, step-sister, half-brother, half-sister) and/or those living in the same household of each such officer, director or employee are not eligible to nominate, be nominated or win a prize. Void where prohibited or restricted by law.

2. HOW IT WORKS: Eligible individuals (each a “Nominator”) may nominate a team of four “Nominees” who meet the eligibility criteria stated above and in this paragraph (a “Team”). The Nominator may include himself or herself as one of the four Nominees on the Team. A Nominator should only nominate individuals whom the Nominator knows personally. A Nominator who does not include himself or herself as one of the four Nominees is not eligible to receive any prize. The Coach cannot be a parent/legal guardian of any of the Nominees. Nominator can nominate himself or herself as Coach if he/she meets the criteria. Entries with less than 4 Nominees and mixed gender teams will be disqualified.

3. NOMINATION: Beginning on 2/25/10 at 12:00:01 a.m. Eastern Standard Time (EST) and ending 11:59:59 p.m. Eastern Daylight Time (EDT) on 4/05/10 ("Contest Period") logon to www.livepositively.com/cokesoccercamp and follow the instructions to complete the nomination form. Nominators will be required to provide the following information on the nomination form:

  • Each Team Member’s (Nominees) first and last name and date of birth
  • The name of one parent/legal guardian for each Team Member, and that parent/legal guardian’s contact information: address, daytime phone number or email address. A minimum of two points of contact are required.
  • Coach’s first and last name and date of birth
  • Coach’s contact information: address, daytime phone number or email address. A minimum of two points of contact are required.

  • After completion of the nomination form, submit an essay describing how the nominated Team (as individuals or as a team) in addition to playing soccer, “Lives Positively”. Nominator is encouraged to collaborate with Team members in writing the essay. Give specific examples of how the team maintains a healthy and active lifestyle through soccer; how many individuals have been motivated because of the Team’s leadership in team-building/spirited activities and actions; how the team demonstrates leadership qualities on and off the soccer field; and how the team members make education and working hard in school a priority.

    Essays will be judged on specific examples provided and not on writing ability. Information stated in your Essay must be truthful and is subject to verification by Sponsor. Essays must be written in English with no more than 5,000 characters (approximately 750-800 words). Essays with more than 5,000 characters may be disqualified at Sponsor’s discretion. You may nominate as many different Teams as you would like, however, only one nomination per Nominee is permitted by each Nominator; a Nominator may not Nominate the same individual for more than one Team and doing so may result in disqualification of such Nominations at Sponsor’s sole discretion. By submitting a nomination, Nominator represents that the Essay submitted is original work, has never been published, has not previously won any other contest award, use thereof does not infringe third party rights, and is suitable for publication, and that the right to submit the Essay is not restricted by copyright. Essays cannot defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights. Nominations not complying with all rules are subject to disqualification. No correspondence regarding nominations will be entered into with Nominators. Nominator unconditionally assigns and transfers to Sponsor all rights, title, interest and claim to the Essay, including, without limitation, the copyright therein. All entries become the property of The Coca-Cola Company (“Sponsor”) and will not be acknowledged or returned. Sponsor shall have right to use, alter, assign or dispose of Essays for any purpose however it sees fit including, without limitation, in advertising and promotional materials, without approval of Nominators.

    4. JUDGING CRITERIA:
    Round 1: On or about 4/06/10 an independent judging organization selected by Sponsor in its sole discretion, will judge all Essays received, based on the following criteria:

    (50%) Maintains Healthy, Active Lifestyle through Soccer: Team leads a healthy and active lifestyle through soccer. (Examples: frequency of play, off-season cross training, attendance at soccer camps, personal practices.)

    (25%) Leadership: Team demonstrates leadership qualities on and off the soccer field. Team inspires their peers/community to play soccer/team-building sports and inspires participation in community activities. Describe how many individuals and give examples of how such individuals have been motivated because of the Team’s leadership in team-building/spirited activities and actions.

    (25%) Education: Team demonstrates importance of scholastic fitness. (Examples: maintains good grades, participates in academic/school activities or tutoring.)

    The fifty (50) highest scoring Essays (provided a sufficient number of eligible entries are received) will advance to Round 2 of judging. In the event of a tie for the final place, all Essays tied for the final place will advance to Round 2. If fewer than 50 eligible entries are received, all eligible entries will advance to Round 2 of judging.

    Round 2: The fifty (50) highest scoring Essays from Round 1 of judging will be re-judged on or about 4/08/10 by a second panel of qualified judges selected by Sponsor in its sole discretion, based on the same criteria for Round 1. The Nominees featured in the top two scoring Essays from Round 2 will be declared the potential Grand Prize winners, subject to verification. The Nominees featured in the next twenty five (25) highest scoring Essays will be declared potential First Prize winners, subject to verification.

    In the event of a tie, the tie will be broken based on the highest score for the Maintains Healthy, Active Lifestyle through Soccer. If a tie remains, it will then be broken based on the highest score for Leadership. Judges’ decisions are final on all matters relating to this Contest. Potential Grand Prize winning Team members and Coaches will be notified by phone and/or overnight mail. Potential First Prize winning Team members and Coaches will be notified by email and prizes will ship approximately 4-6 weeks from contest end date.

    5. PRIZES: (2) Grand Prizes – a trip for the four (4) Team members and one (1) designated Coach to Pretoria, South Africa where the Team will participate in the Coca-Cola 2010 International Soccer Camp from June 15, 2010 – June 20, 2010. Prize consists of roundtrip coach air transportation for the four (4) Team members and Coach from a major city near Team’s home, as determined by Sponsor in its sole discretion, to Atlanta, GA and roundtrip coach air transportation from Atlanta, GA to Johannesburg, South Africa, 6 day/5 night accommodations at TUKS Village, ground transportation to/from South African airport and camp as well as all camp sponsored activities; 3 meals daily, soccer and tournament training, a half-day African Safari and attendance to one FIFA World Cup Soccer Game. The approximate retail value of each trip per person is $9,400. Actual retail value of trip will depend on airfare fluctuations and point of departure/return. Any difference between stated approximate retail value and actual value of prize will not be awarded. Winning Nominees and Coach must be able to travel on Sponsor-specified dates and must travel on the same itinerary or prize will be forfeited in its entirety. Trip is non-transferable and Team members/Coach may not be substituted. If any Team member or Coach is unable to attend for any reason, the entire Team may be required to forfeit the prize and the prize may be awarded to the members of the Team featured in the next highest scoring Essay, at the Sponsor’s sole discretion, time permitting. Winning Nominees and Coach must possess required travel documents (e.g. valid Passport) and obtain any necessary vaccinations, if applicable, prior to departure. Any other expenses related to prize, including but not limited to, luggage fees and personal expenses, are the sole responsibility of selected winning Nominees and Coach. (25) First Prizes – one soccer ball for each Team member and Coach. ARV: $25. Sponsor reserves the right to substitute prize of equal or greater value. Prizes consist of only the items specifically listed as part of the prize. Prizes cannot be redeemed for cash and are valid only for the items detailed above, with no substitution of prizes by winner. If a prize element is not available for any reason, the remaining elements of prize shall constitute full satisfaction of Sponsor’s obligation to winner and no additional compensation will be awarded. Sponsor is not responsible if any event or program included in the prizes above is delayed, postponed or cancelled for any reason, in which event that portion of the prize is forfeited in its entirety.

    Prize does not include transportation or accommodations for parents/legal guardians of Team members. Parents/legal guardians of Team members may accompany their children on the trip at their own expense, but will not be allowed to attend the camp or any camp sponsored activities with their children.

    6. NOTIFICATION AND VERIFICATION: Each potential Grand Prize winning Team member’s parent/legal guardian and the potential Grand Prize winning Coach will be notified by telephone and/or overnight mail. The Coach will be required to consent to a background check by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual whose past conduct might pose a danger to the Team members, reflect negatively on the Sponsor or bring the Sponsor into disrepute for any reason, as determined by Sponsor in its sole discretion. If Coach does not consent to a background check or does not pass the background check, the Team may be required to forfeit the prize and the prize may be awarded to the members of the Team featured in the next highest scoring Essay, in Sponsor’s sole discretion, time permitting. Each potential Grand Prize winning Team Member’s parent/legal guardian (on behalf of their child/legal ward) and each Coach will be issued an Affidavit of Eligibility and Release of Liability/Publicity Release Form which must be completed within six (6) days of notification. Additional documentation required by Sponsor, International Soccer Camp, and/or any applicable sanctioning body shall also be required as appropriate. The Publicity Release includes consent for Sponsor and its Promotional Participants, and those acting under their control to use the Team members and Coach’s name, picture, voice, likeness, the contents of the Essay and for purposes of advertising, trade and promotion, in any manner Sponsor shall elect in any medium now or hereafter known including, but not limited to, website, television, radio and/or printed materials, worldwide in perpetuity, without further compensation, notification or permission, unless prohibited by law. If the foregoing documents are not executed by the prescribed persons noted therein and returned within six (6) days of notification, or if notification is returned as non-deliverable, or if any Team member/Coach is found to be ineligible or otherwise not in compliance with these Rules, the Team may be required to forfeit the prize at the sole discretion of Sponsor and at Sponsor’s discretion, in which event the prize may be awarded to the members of the Team featured in the next highest scoring essay, time permitting. Nominators (or Nominator’s parent/legal guardian if Nominator is deemed a minor in his/her state of residence) of the potential winner may be issued a Publicity Release Form, which must be signed and returned within six (6) business days of attempted notification.

    7. GENERAL: All federal, state and local taxes are the sole responsibility of winners. All federal, state and local laws and regulations apply. The Grand Prize winning Nominees and Coach will each be issued a Form 1099, for tax purposes for the retail value of the prize. Winners are advised to seek independent counsel regarding the tax implications of the respective prize winnings. By participating in this Contest, and/or by accepting a prize Nominators, Nominees and Coaches agree to abide by and be bound by these Official Rules and the decisions of the judges, which are final in all matters relating to this Contest. By accepting prize, winners waive the right to assert as a cost of winning a prize, any and all costs of redemption and any liability which might arise from redeeming or seeking to redeem said prize, or from use, misuse, acceptance or possession of said prize. By participating/and or by accepting a prize Nominators, Nominees and Coaches agree to release Sponsor, Coca-Cola Bottlers, Gage Marketing, LLC, as well as all other organizations affiliated with any prize component and their respective parents, subsidiaries, affiliates, agents, agencies, officers, directors, and employees (“Released Parties”), from any and all liability arising from or in connection with participation in this Contest, or the awarding, receipt or use of any prize. The Released Parties are not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of Nominations, whether caused by the sender or any of the equipment or programming associated with or utilized in the Contest; (ii) the unavailability or inaccessibility of any transmissions or telephone or internet service; (iii) unauthorized human intervention in any part of the Nomination process or the Contest; (iv) electronic, clerical or human error which may occur in the administration of the Contest or the transmission, receipt or processing of Nominations or notification of potential winners; or (v) any injury or damage to persons or property, including but not limited to Nominator’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from Nominator’s participation in the Contest. Without limiting the generality of the foregoing, Sponsor reserves the right, in its sole discretion, to terminate, modify, cancel or suspend this Contest if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Sponsor corrupt the administration, security, or proper play, of the Contest. In the event of cancellation, a notice will be posted online, entries received prior to termination will be judged and prizes awarded from among all eligible, non-suspect entries received prior to the event requiring cancellation. The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor (excepting compliance with applicable codes and regulations), or other force majeure event will not be considered a breach of these Official Rules. Under no circumstances, including negligence, shall the Released Parties be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the website, or out of any breach of any warranty. This exclusion or limitation of liability will not apply to the extent that any applicable statute prohibits such exclusion or limitation of liability. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SPONSOR’S WEBSITE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES; CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS OR RESTRICTIONS. Any attempt to deliberately damage any website or undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Nominator engaging in any of the foregoing activities may be disqualified and his/her nomination(s) withdrawn from consideration. If such activities are discovered after a winner has been selected, Sponsor, may, at its discretion, disqualify the selected Team and select an alternate. Acceptance of prize constitutes permission to the Sponsor to use winners’ names and/or likenesses for purposes of advertising and trade without further compensation, unless prohibited by law. By accepting prize, winners’ parent/legal guardian and Coach agree to release and hold Released Parties assigns, harmless against any and all claims, damages, losses, expenses and liability arising out of acceptance or use of prize. Nominator, Nominees and Coaches (or Nominator/Nominee’s parent/legal guardian if applicable) assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest, and the acceptance and use of any prize. By participating in this Contest, Nominator, Nominees and Coaches (or Nominator/Nominee’s parent/legal guardian if applicable) agree to be bound by the Official Rules and the decisions of the judges. The Released Parties are not responsible for any typographical or other error in the printing, the offering or the announcement of any prize or in the administration of the Contest. DISPUTES: The Contest is governed by, and will be construed in accordance with, the laws of the State of Georgia, and the forum and venue for any dispute shall be in Atlanta, Georgia. THE PARTIES AGREE THAT THE REMEDY FOR ANY CLAIM BROUGHT PURSUANT TO THIS AGREEMENT SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.

    8. WINNERS LIST: For the names winners, available after 6/01/10, send a separate, self-addressed, stamped (#10) envelope to: 2010 Coca-Cola Soccer Camp Contest Winners List, PO Box 27792, Golden Valley, MN 55427 to be received by 4/15/10.
